A Florida woman has been awarded more than $11.3 million in damages after a jury found Target largely responsible for a fall that left her with severe leg injuries outside one of its stores in Winter Garden.
The 44-year-old woman, represented by Morgan & Morgan attorneys Matt Morgan, Fan Li, and Perry Nava, had previously turned down a $250,000 pre-trial settlement offer before securing the multi-million-dollar verdict.
According to court documents, the incident happened on December 23, 2019, when the woman parked at the Winter Garden Village Target and began walking through the parking lot with her daughter. Trying to avoid puddles and heavy holiday traffic, she stepped near a landscaped area — right where the asphalt met a concrete curb. The uneven surface, which was later found to violate multiple building codes, caused her to trip and fall.
She suffered multiple fractures to her right leg — including her tibia, fibula, and lateral malleolus — after twisting her left ankle and falling while holding her child.
After reviewing the evidence, the jury determined that Target was 90% at fault for failing to maintain a safe walking area on its property.
The case highlights the importance of proper maintenance and safety compliance in high-traffic retail environments, especially during busy holiday seasons.
